Gamerbashi Terms of Service

1. Acceptance of Terms

Gamerbashi currently operates under this trade name while our company registration is in progress.

2. Description of Service

Gamerbashi provides game server hosting and related infrastructure, accessible through our online control panel.

3. Eligibility

You must be at least 18 years old to enter into a paid agreement with us. If you're under 18, you may use the Service only with the consent and involvement of a parent or legal guardian, who agrees to be bound by these Terms and is responsible for all account activity and charges.

4. Your Account

You are responsible for the following regarding your account:

• Keeping your login credentials confidential
• All activity under your account
• Notifying us right away at support@gamerbashi.com if you suspect unauthorized access
• Providing accurate account information and keeping it up to date

5. Payment and Billing

The following payment and billing terms apply:

• Prices are listed in Toman on our website and may change with reasonable notice.
• We do not yet have a payment gateway — no payments are processed until one is in place. We will never store your card details.
• Services are billed monthly. Unpaid invoices may lead to suspension or termination of your server(s) after a grace period.
• You are responsible for any applicable taxes.

6. Refunds and Cancellations

Once a server has been provisioned, purchases are generally non-refundable, except:

• Where the Service was materially defective due to our fault, or
• Where required by applicable law.

If you think you were charged in error, or experienced a verified extended outage, contact support@gamerbashi.com within 7 days of the charge. Any refund or service credit is given at our discretion.

7. Acceptable Use

You agree not to use the Service to:

• Host or distribute pirated, cracked, or illegally obtained software or game files
• Launch DDoS attacks, port scans, or other attacks against any system
• Distribute malware, phishing content, or spam
• Host illegal content of any kind
• Mine cryptocurrency unrelated to your game server's normal operation
• Resell hosting resources without our prior written permission
• Violate the end-user license agreement (EULA) or terms of the game(s) you host

We may investigate suspected violations and take action, including suspension or termination.

8. Service Availability

We aim to keep our Service reliably available, but we don't guarantee uninterrupted, error-free, or completely secure operation. We'll try to announce planned maintenance in advance when practical.

9. Backups

You are responsible for keeping your own backups of your game server data. We may offer backup tools, but we don't guarantee against data loss — keep independent copies of anything important.

10. Suspension and Termination

We may suspend or terminate your account or server(s):

• For non-payment, after a grace period and notice where practical
• For violation of these Terms
• For suspected fraudulent, illegal, or harmful activity — immediately if needed to protect our systems or other users

You can cancel your account at any time. Cancellation doesn't entitle you to a refund except as described in the "Refunds and Cancellations" section.

11. Intellectual Property

Intellectual property is allocated as follows:

• You keep ownership of the content, game worlds, configurations, and data you upload or create on your server.
• Gamerbashi keeps all rights to its own trademarks, logos, software, and platform.

12. Limitation of Liability

To the maximum extent permitted by applicable law:

• Gamerbashi is not liable for indirect, incidental, special, or consequential damages (including loss of data, profits, or business).
• Our total liability for any claim relating to the Service is limited to the amount you paid us in the 3 months before the claim arose.

13. Indemnification

You agree to indemnify and hold Gamerbashi harmless from claims, damages, or expenses arising from your use of the Service or violation of these Terms.

14. Governing Law and Disputes

These Terms are governed by the laws of the Islamic Republic of Iran. Any dispute will first be handled through good-faith negotiation; if unresolved, it will be subject to the jurisdiction of the competent courts of Iran.

15. Changes to These Terms

We may update these Terms from time to time. We'll update the "Effective date" above and, for significant changes, let you know (by email or a website notice). Continuing to use the Service after changes take effect means you accept the updated Terms.
